1. Introduction & Acceptance

These Terms of Service ("Terms") govern your access to and use of the OBIT platform, website, and related services (collectively, the "Service") operated by Dadgommit Ltd ("we", "us", or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. Description of Service

OBIT is an AI search visibility tracking platform. The Service allows you to:

• Monitor how your brand appears in AI-generated search results
• Track citations and mentions across AI platforms
• Analyse competitor visibility in AI search
• Receive recommendations for improving AI visibility

OBIT monitors and reports on AI search results. It does not influence, manipulate, or guarantee any specific AI search outcomes.

3. Account Registration

To use the Service, you must create an account. You may sign up using your email address or through a supported social sign-in provider. You are responsible for:

• Providing accurate and complete registration information
• Maintaining the security of your account credentials
• All activity that occurs under your account

You must notify us immediately if you suspect any unauthorised access to your account.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorised access to any part of the Service
• Interfere with or disrupt the Service or its infrastructure
• Reverse-engineer, decompile, or disassemble any part of the Service
• Use the Service to harass, abuse, or harm others
• Resell or redistribute the Service without our written permission
• Use automated systems (bots, scrapers) to access the Service beyond its intended use

We reserve the right to suspend or terminate accounts that violate these terms.

5. Subscription & Payment

OBIT offers the following subscription plans:

• Starter: €79 per month (includes a 14-day free trial)
• Pro: €149 per month
• Agency: Custom pricing (contact sales)

All prices are in Euros (EUR) and exclude any applicable taxes. Payments are processed securely through Stripe. Subscriptions renew automatically each month unless cancelled before the renewal date.

6. Free Trial

The Starter plan includes a 14-day free trial. A valid payment method is required to start the trial. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription and you will be charged the applicable monthly fee.

7. Intellectual Property

The OBIT platform, including its design, code, features, and branding, is owned by Dadgommit Ltd and protected by intellectual property laws. Your use of the Service does not grant you any ownership rights in the platform.

We grant you a limited, non-exclusive, non-transferable licence to use the Service for the duration of your subscription, subject to these Terms.

8. Customer Data

You retain all rights to the data you provide to OBIT, including brand names, keywords, and tracking configurations ("Customer Data"). We process Customer Data solely to provide the Service to you.

We may use anonymised, aggregated data derived from the Service for product improvement and analytics, provided that such data does not identify you or any individual.

9. Service Availability

We aim to provide the Service on a continuous basis but do not guarantee uninterrupted availability. The Service may be temporarily unavailable due to:

• Scheduled or emergency maintenance
• Changes to third-party AI platforms that affect our ability to track results
• Circumstances beyond our reasonable control (force majeure)

We will make reasonable efforts to notify you in advance of any planned downtime.

10. No Guaranteed Results

OBIT provides visibility tracking and analytics. We do not guarantee any specific outcomes, including but not limited to:

• Improved visibility in AI search results
• Increased citations or mentions
• Any particular business outcomes

AI search results are determined by third-party AI platforms and are outside our control.

11. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied.
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
• Our total liability for any claims arising from or related to the Service shall not exceed the total amount you paid to us in the 12 months preceding the claim.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under the laws of England and Wales.

12. Termination

You may cancel your subscription at any time through your account settings or by contacting us. Upon cancellation:

• Your access continues until the end of your current billing period
• No refunds are provided for partial billing periods
• Your data will be retained for 30 days after account termination, after which it will be permanently deleted upon request

We may terminate or suspend your account if you breach these Terms, with or without notice depending on the severity of the breach.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

14. General Provisions

• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
• Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service.
• Amendments: We may update these Terms from time to time. Material changes will be communicated via email or a notice on our website. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
• Assignment: You may not assign your rights under these Terms without our written consent. We may assign our rights and obligations without restriction.
